Booking and Payment:

• All bookings must be made in writing via email.
• A 50% deposit is required upon tour confirmation.
• For bookings made 45 days or less before the tour starts, full payment is required immediately upon confirmation.
• For group bookings, a non-refundable deposit may be required periodically for confirmation.
• Full payment must be made to Luta Tours & Safaris no later than 30 days before the tour begins.
• Luta Tours & Safaris reserves the right to cancel any booking without notice if payment is not received by the due date. Upon request, a new quote can be provided, including any applicable surcharges.
• Upon receipt of payment, Luta Tours & Safaris will provide services at the quoted price but reserves the right to adjust prices if influenced by factors beyond its control.
• For payments in a currency other than that on the invoice, please request the current exchange rate.

Cancellation and Amendments:

• All bookings and amendments must be sent in writing via email to Luta Tours & Safaris Limited, and a fee will be charged. Luta Tours & Safaris reserves the right to determine the receipt date of such requests due to possible communication delays.
• Cancellations made:
  • Between the time of booking and 40 days before the tour: 30% cancellation fee.
  • Between 39 to 20 days before the tour: 50% cancellation fee.
  • Between 19 to 7 days before the tour: 75% cancellation fee.
  • Within 6 days of the tour: 100% cancellation fee.
• During peak travel times, full cancellation policies may apply due to advance payments to hotels and lodges.
• Cancellation requests must be in writing, and there are no refunds for unused portions of the tour.
• Amendments to a booked tour will be accommodated with minimal penalties when possible, but clients are responsible for any unavoidable amendment charges.

Inclusions in Tour Cost:

• Transport as specified in the Final Operating Itinerary (FOI).
• Accommodation as specified in the FOI.
• Sightseeing and game drives as specified in the FOI.
• Flights as specified in the FOI.
• Government hotel taxes, service charges, and airport service charges included in the FOI.

Exclusions from Tour Cost:

• International flights and airport taxes unless specified in the FOI.
• Visa fees, personal items (e.g., drinks, laundry, communication costs) unless specified in the FOI.
• Supplementary charges imposed by hotels from time to time.

Accommodation and Tour Details:

• Single or private rooms are not guaranteed even if requested and confirmed.
• Luta Tours & Safaris will try to ensure requested accommodations but reserves the right to substitute similar facilities if necessary. They may also change routes or arrangements and cancel tours if conditions require.
• Luta Tours & Safaris reserves the right to decline to accept or retain any tour member, refunding an equitable amount if necessary.
• They are not liable if clients decline optional arrangements offered beyond their control.

Transportation:

• Safaris are provided in tour vans, other vehicles, aircraft, or coaches as deemed necessary. Transportation may be outsourced if needed.

Client’s Insurance and Responsibilities:

• Clients must have adequate insurance for personal accidents, medical expenses, emergencies, and property loss or damage.
• Clients must ensure their travel documents are in order.
• Clients must reconfirm airline flights at all stopovers 72 hours before departure.
• Clients should request special attention for diets, disabilities, or medical needs in advance. Luta Tours & Safaris will attempt to accommodate these needs but is not responsible for shortfalls beyond their control.

Luta Tours & Safaris Responsibilities:

• Luta Tours & Safaris acts as an agent for transportation, accommodation, meals, and other services unless they own the facilities. They subcontract the best facilities available but are not liable for any shortfalls.

Refunds:

• Refunds will be provided for services not rendered due to Luta Tours & Safaris’s negligence or shortcomings.

Limit of Liability:

• Luta Tours & Safaris is not responsible for severe injury or death due to inherent risks in certain activities, such as wildlife encounters, hot air ballooning, domestic flights, mountain climbing, or rafting.
• They are not liable for losses or expenses due to sickness, quarantine, weather, Acts of God, strikes, civil disturbances, wars, customs regulations, or similar causes.

Laws of the Land:

• All matters regarding these conditions are subject to the laws of the Republic of Kenya. Clients submit to the exclusive jurisdiction of Kenyan courts for any claims.
